If your money is seized by a federal agent, an attorney can help you immediately file a claim for court action to bypass the administrative proceedings. Those administrative proceedings include making an offer in compromise or filing a petition for remission or mitigation.
For our clients, we almost ALWAYS recommend filing a claim for court action. People who file a claim without an attorney often forget to put all of the appropriate information in the claim or verify it properly. Also, it must be RECEIVED by the appropriate federal employee within the deadline, or it will be DENIED as untimely.
The filing of the claim for court action triggers a 90-day deadline for the federal agency that received the claim to send the claim and the civil judicial forfeiture referral to the Asset Forfeiture Unit of the United States Attorney’s Office for the appropriate division of the District court.
After filing the claim, you might receive correspondence from an FSA Senior Law Clerk who might ask:
“Are you amenable to a CAFRA extension to see if the case can be resolved in advance of filing a complaint?”
