Cryptocurrency has become a significant asset in the digital age. Law enforcement agencies in Florida are devoting more resources to seizing cryptocurrency accounts from foreign nationals.
The Florida Contraband Forfeiture Act governs the seizure and forfeiture of property, including cryptocurrency, when linked to criminal activity. This Act allows law enforcement agencies to seize assets believed to be involved in or derived from criminal conduct. The process typically begins with law enforcement obtaining a seizure warrant, which requires demonstrating a nexus between the cryptocurrency and alleged criminal activity.

Seizure Process and Legal Proceedings in Florida
Once a seizure warrant is obtained, agencies may proceed with seizing the cryptocurrency. Within 10 days of that seizure, the agency must file an application to determine probable cause. Within 45 days of the seizure, the agency must file a complaint in the Circuit Court to initiate forfeiture proceedings.
The agency might also seek an arrest warrant for the owner of the cryptocurrency account. Then the agency might assert the fugitive disentitlement doctrine under § 896.106, Fla. Stat., to defeat any answer or motion to dismiss the complaint filed by the claimant. This doctrine can prevent claimants from defending against forfeiture unless they submit to U.S. jurisdiction by surrendering on the arrest warrant.
Of course, that presents a catch-22 situation, because the Claimant might have no ability to obtain a Travel Visa to legally enter the U.S. to surrender on the warrant.
Jurisdictional Issues in Cryptocurrency Seizures in Florida
Seizing cryptocurrency presents unique challenges, including jurisdictional issues and the technical complexities of accessing digital assets. The legal landscape is further complicated for foreign nationals, who may face additional hurdles under Florida law. Procedures for Cryptocurrency Seizures in Florida
The procedures used by law enforcement agencies in Florida might include:
- obtain a seizure warrant alleging a nexus between the funds in a cryptocurrency account and a crime committed in that jurisdiction;
- obtain an arrest warrant for the owner of the account based on the same allegations;
- file a Complaint in the U.S. District Court;
- file a motion requesting that the Court allow alternate service by email;
- publish notice to all other potential claimants on https://floridapublicnotices.com;
- when the claimant files an answer and/or motion to dismiss, file a motion to strike those pleadings under the fugitive disentitlement doctrine found in § 896.106, Fla. Stat. claiming that since the claimant is a fugitive from justice, he should be enjoined from defending this action unless and until he submitted himself to the jurisdiction of the criminal courts of the United States within the time prescribed by § 932.703(1)(c), or a designated number of days from some date specified by the court;
- when the claimant fails to submit himself to the jurisdiction of the United States, as demonstrated by the still-active arrest warrant, the agency might file a motion for entry of a clerk’s default process pursuant to § 896.106, Fla. Stat.
