DUI Refusal in Orlando, FL
If you were charged with DUI and refused to submit to a breath, blood, or urine test, this article explains the best ways to protect your driver’s license and resolve the court case.
If you refuse to submit to a breath, blood, or urine test, you face more serious consequences for two reasons.
First, the failure to submit to a lawful breath test might cause a long administrative suspension of your driving privilege. For example, if you take the breath test and blow over the legal limit, for 12 months for a first refusal or 18 months for a subsequent refusal.
Second, if you refuse to submit to a breath test for a first offense, you can be charged with a second degree misdemeanor punishable by up to 60 days in jail and a $500 fine. If you refuse to submit to a breath test, and you have previously refused, you can be charged with a first-degree misdemeanor, punishable by up to one year in jail and $1,000 fine. Those penalties for refusal are in addition to the penalties for the underlying DUI charge.
For example, a first conviction of driving under the influence (DUI) can result in a fine of at least $500, 50 hours of community service, imprisonment of no more than six months, up to one year of probation, a court order to install an ignition interlock device for at least six continuous months, and completion of an authorized substance abuse course.
