Expunge Arrest Record in Florida Related to Out of State Case
What happens if you get arrested in Florida for a case that originated outside of Florida? When that case is resolved in the other case, you can petition to expunge your record there. When you receive that order, you or your attorney can send that order to the Florida Department of Law Enforcement (FDLE) to request that they expunge the Florida criminal history record related to that case. The request is based solely on the out-of-state expunction order, without making any attempt to use up your one lifetime petition for a court-ordered expunction.
We recently had such a case. Although other attorneys had told our client it could not be done, we researched the law and requested that FDLE expunge any record of the Florida record based solely on the out-of-state order for expunction. A few months after submitting the request to FDLE on behalf of our client, we received a letter that provided:

If the order referenced above is from a jurisdiction outside of Florida, compliance with the order is, by Florida law, at the discretion of the criminal justice agency receiving the order. FDLE’s compliance with the order does not constitute legal advice or a recommendation to your agency that it should or should not comply with the order.
