Auditing FDLE Form 36a Department Inspections on Florida’s Intoxilyzer 9000

As the Florida Department of Law Enforcement (FDLE) transitions evidentiary breath testing from the legacy CMI Intoxilyzer 8000 to the Intoxilyzer 9000, defense scrutiny must adapt to the new regulatory architecture under Chapter 11D-8 of the Florida Administrative Code (F.A.C.).

While monthly agency inspections conducted by local law enforcement officers receive frequent attention, the annual state-level Department Inspection remains the primary prerequisite for an instrument’s evidentiary qualification.

Under Rule 11D-8.004, F.A.C., an Intoxilyzer 9000 cannot be used for evidentiary breath testing unless it has undergone an annual inspection by an FDLE Department Inspector, conducted strictly pursuant to “FDLE/ATP Form 36a (Department Inspection Procedures – Intoxilyzer 9000).”

The BrAC results must be certified on “FDLE/ATP Form 41a (Department Inspection Report – Intoxilyzer 9000).

When an inspector cuts corners, skips mandatory calibration standards, repeats out-of-tolerance cycles without recording corrective action, or lets the 12-month clock expire, the instrument loses its administrative predicate—stripping the State of its statutory presumption of impairment under Florida Statutes § 316.1934.

Step-by-Step Defense Audit of Form 36a / Form 41a

1. The 12-Month Expiration Clock (Rule 11D-8.004)

Under Rule 11D-8.004(3), an evidentiary instrument must have a Department Inspection completed at least once every 12 months.

This is a bright-line expiration rule: if an instrument’s previous Department Inspection was completed on April 5, 2025, its evidentiary authorization expires on April 5, 2026.

If the client’s breath test was administered on April 6, 2026, without an intervening Form 41a, the test was administered on an uncertified machine as a matter of law.

2. Auditing “Repeat” Analyses for Missing Corrective Action

Scan all ten repetitions across each standard on Form 41a (the 0.000 water blank, interferent check, 0.05, 0.08, and 0.20 dry gas standards). Under Form 36a:

  • Each test may be repeated only once;
  • If any test falls out of tolerance, the inspector must record the corrective actionin the Remarks section.

If the Form 41a reflects an initial out-of-tolerance reading followed by a `(Repeat)` line, but the Remarks section simply reads “Annual Inspection” or lists accompanying personnel, the Department Inspector violated Form 36a. Under State v. Donaldson, 579 So. 2d 728 (Fla. 1991), failing to document corrective action for an out-of-tolerance failure defeats substantial compliance and invalidates the report.

3. Statistical Standard Deviation Verification

Calculate the individual standard deviations and the combined average standard deviation across the ten repetitions for the 0.05, 0.08, and 0.20 g/210L standards. If any individual standard deviation or the combined average exceeds the statistical ceiling (e.g., > 0.0042), the instrument failed precision verification and was ineligible to remain in service.

4. Barometric Pressure Sensor Calibration (±1% Rule)

Because the Intoxilyzer 9000 calculates target values for dry gas standards based on ambient atmospheric pressure, barometric accuracy is essential.

Form 36a requires comparing the instrument’s internal pressure sensor to a certified external barometric gauge, mandating agreement within ±1%.

Defense counsel should subpoena the NIST-traceable calibration certificate for the external barometer utilized by the Department Inspector to confirm it was within its annual calibration window during the inspection.

5. Reagent Expiration and Lot Auditing

Under Form 36a, the inspector must record lot numbers and expiration dates for the mouth alcohol solution, the acetone stock solution, and each dry gas standard cylinder.

Cross-reference every lot number against FDLE’s approved chemical registry. If the inspector used an expired acetone stock solution or an unapproved dry gas lot, the inspection is invalid on its face.

Litigation Strategy: Suppressing Breath Test Results via Form 41a Deficiencies

Subpoena the FDLE Department Inspector: Department Inspectors are state employees headquartered through FDLE regional operational centers. Issue a witness subpoena for deposition or the pre-trial evidentiary hearing. Walk the inspector line-by-line through Form 36a, locking them into the mandatory nature of each directive.

Expose Undocumented Adjustments: If a retest occurred, question the inspector on what physical corrective action was performed. If the inspector admits they do not remember, made no physical adjustments, or merely hit “repeat” until the machine produced an acceptable number, the scientific integrity of the optical bench is unverified.

File the Motion to Suppress / Motion in Limine: Move to suppress the breath test under Robertson v. State, 604 So. 2d 783 (Fla. 1992) and State v. Miles, 775 So. 2d 950 (Fla. 2000). Establish that because the annual Department Inspection failed to substantially comply with Chapter 11D-8, F.A.C., the State is stripped of its self-authenticating affidavit under F.S. § 316.1934(5)[cite: 20] and its statutory presumption of impairment.

Force the Common Law Predicate:Without the statutory shortcut, the State must prove that the machine was operating accurately and reliably on the date of the offense under common-law evidentiary rules—a burden the State rarely satisfies when its foundational annual inspection contains documented, uncorrected defects.

Differences Between Form 36a (Intoxilyzer 9000) and Form 36 (Intoxilyzer 8000)

Attorneys accustomed to auditing Form 36 inspections on the Intoxilyzer 8000 must recognize that Form 36a establishes fundamentally different testing protocols and mechanical requirements.

Inspection Parameter Intoxilyzer 8000 (Form 36) Intoxilyzer 9000 (Form 36a) Defense Significance & Audit Focus
Alcohol Calibration Medium Wet Bath Reference Solutions (0.05, 0.08, 0.20 g/210L) + one 0.08 dry gas standard cylinder. 100% Dry Gas Standards (0.05, 0.08, and 0.20 g/210L dry gas cylinders; wet bath eliminated for alcohol concentrations). Eliminates wet bath jar heating/seal errors for alcohol curves[cite: 22], but introduces gas cylinder pressure drops, expiration issues, and barometric elevation sensitivity across all three concentration levels.
Simulator Requirements At least two (2) simulators warmed for ≥ 30 minutes, maintaining 34°C (± 0.2°C). Only one (1) simulator required, containing distilled/deionized water and acetone stock. The single simulator is restricted to the zero-alcohol blank and the acetone interferent check. Failure to allow a 30-minute warm-up or 10-minute warm-up after adding acetone remains a direct rule violation.
Reagent Lot Tracking Only the lot numbers and expiration dates for alcohol reference solutions and the dry gas cylinder were logged. Mandatory entry of lot numbers and expiration dates for mouth alcohol solution and acetone stock solution, in addition to all dry gas cylinders. New Attack Vector: Inspecting whether the inspector used untracked, unapproved, or expired mouth alcohol or acetone stock reagents during the Department Inspection.
Retest Documentation Standard If a test was repeated, the REASON had to be entered when prompted and recorded in Remarks on Form 41. If a test is repeated, the CORRECTIVE ACTION must be recorded in Remarks on Form 41a. The standard is stricter: stating merely “out of tolerance” or “re-ran test” does not satisfy Form 36a; the inspector must articulate the physical corrective action taken prior to the second attempt.
User Interface & Security Keypad navigation; pressing `ESC` twice, scrolling through menus, text passwords. 7-inch touchscreen Level 2 menu; barcode scanning; authenticated by Inspector Permit Number and PIN. Permit number validation confirms the inspector held an active Intoxilyzer 9000 Department/Agency Inspector credential at the exact timestamp of login.
Dry Gas Cylinder Pressure Monitored via external mechanical regulator gauge. Monitored internally with a 25 PSI automated hard-stop error lockout. Pressure logs must be subpoenaed. Running analytical cycles near or at 25 PSI risks standard delivery failure and optical bench instability.
Analytical Repetitions & Precision 10 analyses per standard; standard deviations and average standard deviation capped at 0.0042. 10 analyses per standard; strict standard deviation caps and linear tolerances apply. A mathematical standard deviation exceeding acceptable statistical limits invalidates the machine’s precision baseline for the entire annual cycle.
